Acceptable Use Policy

Thunk Mail has a zero-tolerance policy toward spam and abuse. This Acceptable Use Policy ("AUP") outlines the rules for using our email marketing platform. All users must comply with this policy in addition to our Terms of Service.

1. Anti-Spam Policy

Thunk Mail strictly prohibits the sending of unsolicited bulk email (spam). All emails sent through our platform must comply with applicable anti-spam laws, including:

  • CAN-SPAM Act (United States)
  • GDPR (European Union)
  • CASL (Canada)
  • PECR (United Kingdom)
  • All other applicable national and regional anti-spam legislation

2. Consent Requirements

You must have proper consent from every recipient before sending them email through Thunk Mail:

  • Express consent (opt-in) — Recipients have explicitly agreed to receive emails from you, either through a signup form, checkbox, or written agreement
  • Transactional relationships — You have an existing business relationship with the recipient and the email is relevant to that relationship

The following are not considered valid consent:

  • Purchasing, renting, or borrowing email lists from third parties
  • Scraping or harvesting email addresses from websites
  • Collecting emails from public directories without permission
  • Using pre-checked opt-in boxes
  • Adding people to your list because they gave you a business card

3. Email Content Requirements

Every email sent through Thunk Mail must:

  • Accurately identify the sender (your name or business name)
  • Include a valid physical mailing address
  • Include a clear and functional unsubscribe link
  • Have a truthful and non-deceptive subject line

4. Prohibited Content

You may not use Thunk Mail to send emails containing or promoting:

  • Illegal products, services, or activities
  • Phishing, malware, viruses, or other malicious software
  • Fraudulent or deceptive schemes
  • Hate speech, harassment, threats, or violence
  • Content that exploits minors
  • Counterfeit goods or trademark-infringing material
  • Unauthorized pharmaceutical or controlled substance sales
  • Gambling services (where prohibited by law)
  • Multi-level marketing or pyramid schemes
  • Content that violates the intellectual property rights of others

5. List Hygiene

You are responsible for maintaining clean, healthy email lists:

  • Honor unsubscribes — Process unsubscribe requests within 24 hours. Thunk Mail automatically handles this for emails sent through our platform.
  • Remove bounces — Regularly remove hard-bounced email addresses from your lists. Thunk Mail automatically suppresses hard bounces.
  • Monitor complaints — Keep your spam complaint rate below 0.1%. Accounts exceeding this threshold may be suspended.
  • Remove inactive subscribers — Periodically clean your lists of long-term non-engaged subscribers.

6. Sending Limits and Rate Thresholds

Thunk Mail monitors sending health across the platform. We may take action if your account exceeds the following thresholds:

  • Bounce rate above 5% — Your account may be placed on probation
  • Spam complaint rate above 0.1% — Your account may be suspended
  • Consistently low engagement — We may require you to clean your list before sending again

These thresholds exist to protect our sending reputation, which benefits all Thunk Mail users.

7. Prohibited Practices

In addition to content restrictions, the following practices are prohibited:

  • Sending to purchased, rented, or scraped email lists
  • Using deceptive sender information or misleading subject lines
  • Attempting to circumvent sending limits, rate limits, or account restrictions
  • Creating multiple accounts to evade enforcement actions
  • Using Thunk Mail to relay emails through other mail systems for the purpose of hiding origin
  • Interfering with the platform's operation or other users' accounts
  • Reverse engineering or attempting to access unauthorized parts of our systems

8. Enforcement

Violations of this Acceptable Use Policy may result in:

  • Warning — We will notify you of the violation and request corrective action
  • Probation — Your sending capabilities may be limited while we investigate
  • Suspension — Your account may be temporarily suspended
  • Termination — Severe or repeated violations will result in permanent account termination without refund

We reserve the right to take immediate action without prior notice in cases of severe abuse.

9. Reporting Abuse

If you receive spam or abusive email sent through Thunk Mail, please report it to us at:

We take all reports seriously and will investigate promptly.

10. Changes to This Policy

We may update this Acceptable Use Policy from time to time. We will notify users of material changes via email or through the platform. Continued use of Thunk Mail after changes take effect constitutes acceptance.
